for ordering, sale, and delivery of goods
This Agreement is an official and public offer of the Seller to conclude a contract of sale of goods presented on the website www.losivar.com (hereinafter – the “Website”). This Agreement is public within the meaning of Article 633 of the Civil Code of Ukraine: its terms are the same for all buyers, regardless of their status (individual, legal entity, or sole proprietor), without granting any advantages.
By concluding this Agreement, the Buyer fully accepts the terms and procedure of ordering, payment, delivery, returns, liability, and other provisions set out below.
The Agreement is considered concluded from the moment the Buyer clicks the “Confirm Order” button on the checkout page (section “Cart”) and receives electronic confirmation of the order from the Seller.
Definitions
1.1. Public Offer (the “Offer”) – a public proposal of the Seller, addressed to an indefinite number of persons, to conclude with the Seller a contract for the sale of goods remotely (hereinafter – the “Agreement”) under the terms of this Offer.
1.2. Goods – food products, in particular confectionery/jams/syrups made from young green pine cones, and other products offered by the Seller on the Website, selected by the Buyer and placed in the “Cart.”
1.3. Online Store – the Seller’s Website www.losivar.com, created for concluding retail and/or wholesale sales contracts.
1.4. Buyer – a legally capable individual (18+), legal entity, or sole proprietor placing an order on the Website or in another manner.
1.5. Seller – the business entity specified in the section “Seller’s Address and Details” of this Agreement.
Subject of the Agreement
2.1. The Seller undertakes to transfer the Goods into the Buyer’s ownership, and the Buyer undertakes to pay for and accept them under the terms of this Agreement.
2.2. The date of conclusion of the Agreement (acceptance of the Offer) is the date the Buyer fills in the order form on the Website, provided that electronic confirmation of the order is received.
Order Placement
3.1. The Buyer independently places an order through the “Cart” on the Website, by e-mail, or by phone.
3.2. The Seller may refuse to fulfill an order if the provided data is incomplete or inaccurate.
3.3. Mandatory information: surname, first name; delivery address; contact phone number; for legal entities/sole proprietors – Tax ID/Company Code.
3.4. The name, quantity, and price of the Goods are displayed in the “Cart.”
3.5. The Party that requires additional data has the right to request it.
3.6. Acceptance of the Offer’s terms is carried out by entering the data into the form on the Website or when ordering through an operator.
3.7. The Buyer is responsible for the accuracy of the provided information.
3.8. By placing an order, the Buyer confirms agreement with the terms of this Offer and the Privacy Policy.
Price, Payment, and Delivery
4.1. Prices are set by the Seller and indicated on the Website in Ukrainian hryvnias (UAH). If stated, prices include VAT.
4.2. The Seller may change prices; the price of a unit of Goods already paid for does not change.
4.3. Delivery costs are not included in the price of the Goods. Delivery services are paid for by the Buyer in accordance with the carrier’s tariffs.
4.4. The Seller may provide an estimated delivery cost.
4.5. Payment is deemed completed upon receipt of funds into the Seller’s account.
4.6. Available payment methods are listed on the Website.
4.7. Upon receipt of the Goods, the Buyer checks the quantity, integrity, completeness, and shelf life.
4.8. A signature on the documents confirms the absence of claims.
4.9. Ownership rights and risks pass to the Buyer from the moment of receipt or transfer to the carrier.
Rights and Obligations of the Parties
5.1. The Seller undertakes to: deliver the Goods in accordance with the order and the terms of this Agreement; not disclose the Buyer’s personal information, except in cases provided by law and/or necessary to fulfill the order.
5.2. The Seller has the right to: change the terms of this Offer and prices for the Goods by publishing changes on the Website; changes are effective from the moment of publication.
5.3. The Buyer undertakes to: familiarize themselves with the terms of the Offer and prices before placing an order; provide correct data sufficient for identification and delivery.
Returns and Exchange
6.1. Food products of proper quality are not subject to exchange or return in accordance with current Ukrainian legislation.
6.2. In the event of a defect or damage to the Goods, the Buyer has the right to replacement or refund.
6.3. Refunds are made by bank transfer to the Buyer’s account within 14 calendar days.
6.4. Shipping costs in the case of confirmed defect are covered by the Seller.
6.5. Claims are considered upon submission of supporting documents.
Quality, Shelf Life, and Safety
7.1. The Goods are food products manufactured in compliance with legislative requirements; information is provided on the label.
7.2. Shelf life: 24 months (the exact date is indicated on the label).
7.3. Recommended storage conditions are indicated on the packaging.
Confidentiality and Personal Data
8.1. By providing personal data when placing an order, the Buyer gives voluntary consent for their processing for the purpose of fulfilling this Agreement, and also confirms familiarity with the Privacy Policy (posted on the Website).
8.2. The processing of personal data is carried out in accordance with the Law of Ukraine “On Personal Data Protection” and, where applicable, the GDPR (for buyers from the EU).
8.3. The Seller may transfer personal data to third parties solely for the purpose of fulfilling the order (payment services, carriers, IT providers), as well as in cases provided by law.
8.4. The rights of the data subject are exercised in accordance with legislation and the Privacy Policy (right of access, correction, deletion, etc.).
Liability and Force Majeure
9.1. The Parties are liable for non-performance or improper performance of obligations in accordance with Ukrainian legislation and the terms of this Agreement.
9.2. The Seller is not responsible for delays or damage caused by the carrier, as well as for consequences resulting from the Buyer’s violation of storage/use rules.
9.3. The Parties are released from liability in case of force majeure circumstances (war, state of emergency, epidemics, natural disasters, power supply disruptions, logistics blockages, etc.), confirmed by official documents.
Other Provisions
10.1. The Agreement is concluded in the territory of Ukraine and governed by the current legislation of Ukraine.
10.2. Disputes are resolved through negotiations; if no agreement is reached – in court in accordance with jurisdiction determined by law.
10.3. The Seller has the right to amend this Offer unilaterally by publishing the updated version on the Website. The changes are effective from the moment of publication and apply to orders placed after such publication.
